Supreme Court to Hear Plea Over Woman’s Alleged Illegal Detention in Assam

The Supreme Court on Monday agreed to entertain a man's petition regarding his mother's alleged unlawful detention by Assam Police.

Supreme Court to Hear Plea Over Woman’s Alleged Illegal Detention in Assam

New Delhi, The Supreme Court on Monday agreed to entertain a man's petition regarding his mother's alleged unlawful detention by Assam Police during the unstopped expatriation of tons of illegal foreign nationals to Bangladesh.

Iunuch Ali, 26, who sought the immediate release of his mother Monowara Bewa, who was allegedly detained on May 24 after being lured to Dhubri Police station that was just recording her statement as a witness.

The petition also requested a direction prohibiting her from being deported or "push backed" across any Indian border.

The matter came up before a bench of Justices Sanjay Karol and Satish Chandra Sharma who agreed to hear it.

Senior advocate Kapil Sibal, who appeared for the petitioner, submitted to the court that the lady had previously filed an SLP in the Supreme Court, which is still pending, and was granted bail, yet police was going to subsequently "throw her out"

"We will list it along with the main case. We will hear it," the bench said.

The bench informed the petitioner that his plea would be heard along with the pending SLP.

The SLP appeals the decision of Gauhati High Court which affirmed the Foreigners Tribunal's ruling that Bewa was a foreigner, and had remained pending also for the Supreme Court's hearing since 2017.

When the bench ordered the plea would be heard together with the pending petition, Sibal said, "In the meantime, she is being thrown out."

"Thrown out means?" the bench asked.

Sibal stated that she could have been sent to Bangladesh and the petitioner did not know the location of his mother.

"Where is she, we don't know. At least ask them to tell us that. The son does not know," he argued.

The petitioner was concerned over the practice in Assam of allegedly detaining someone, even when their case was pending, and sending them to Bangladesh in the course of one night.

Bewa has been on bail since December 12, 2019, following a Supreme Court order that allowed the conditional release of detainees who have received more than three years detention in Assam's foreigner detention camps.
