According to ANI, the application moved by college lecturer Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik seeks restoration of statehood within two months. It states that despite the Centre’s earlier assurance, no action has been taken in the last 10 months since the Supreme Court’s judgment on abrogation of Article 370.
This was filed in the already decided case on revocation of Article 370 which was upheld by the Supreme Court, ANI reported. The petitioners, argued by Advocate Soyaib Qureshi, said the delay in restoration of statehood is infringing upon the rights of the people of Jammu and Kashmir and the federal structure of the Constitution of India.

The application further states that the failure to restore statehood is seriously affecting the democratic rights of the citizens of Jammu and Kashmir. It says that the peaceful conduct of recent elections in the region shows that there is no security issue which can’t be addressed immediately to restore statehood.
If the Court doesn’t intervene soon it will further damage the federal system and democracy in Jammu and Kashmir. The downgrade of the region to UT status has already resulted in a diminished form of elected government which will come into effect soon after the assembly elections.
The application also says that the delay is violative of the fundamental rights of the citizens of Jammu and Kashmir and is undermining the democratic structure and territorial integrity of the state. It emphasizes the need to restore the federal relationship of the state with the Union of India so that it can have autonomy and continue to play its role in the overall development of the country.
