Kejriwal’s Lawyer Defends ‘No Threat’ in Supreme Court Money Laundering Case

Kejriwal appealed against the court judgment and order which was on 09 April 2024 by a Judge of the High Court of Delhi.

Kejriwal’s Lawyer Defends ‘No Threat’ in Supreme Court Money Laundering Case

Kejriwal appealed against the court judgment and order which was on 09 April 2024 by a Judge of the High Court of Delhi. The Criminal Writ Petition filed by Arvind Kejriwal under Articles 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973. He was arrested on the grounds of the Money Laundering Act, 20023, and the proceedings pursuant.

The petition of jailed CM isn't regarding bail but against the legality of the arrest under Section 19. CBI took Kejrival in custody under offenses punishable under Section 120B read with Section 477A of the Indian Penal Code, 18606, and Section 7 of the Prevention of Corruption Act, 1988.

Justice Surya Kant and Justice Ujjal Bhuyan of the Supreme Court were in charge of the case today and after a long hearing, they made a verdict on the case. Senior lawyer Abhishek Manu Singhvi represented Kejriwal and CBI was represented by advocate (ASG) S V Raju.

Kejriwal released orders under PMLA stringent law which has a bar of Section 45. Kejriwal's Lawyer argues that the arrest was unlawful as the Dehli CM's name was not there on the FIR and was called for eight to nine hours as a witness and got arrested later by the ED and not CBI.

This is my preliminary objection. On merits, the trial court could have seen it first. HC was made to see merits and it can only be in exceptional cases. In ordinary cases, sessions court has to be approached first,” ASG Raju Said"They came here and then they approached the High Court, and then again they came to sc, and then this court decided the matter,"

Apex court dismissed Kejriwal's plea and advised him to seek justice from the trial court, as CBI's lawyer made an argument made a point the CM skipped the trial court before coming to SC and stated that that arrest was on reasonable ground.
