Delhi Police Clarifies: Chaitanyanand Saraswati Is Not a Sanyasi

On Monday, Delhi Police indicated that Chaitanyanand Saraswati is not sanyasi. The Police made this assertion in a response to the request by Chaitanyanand Saraswati in Patiala House Court.

Delhi Police Clarifies: Chaitanyanand Saraswati Is Not a Sanyasi

Delhi Police Clarifies: On Monday, Delhi Police indicated that Chaitanyanand Saraswati is not sanyasi. The Police made this assertion in a response to the request by Chaitanyanand Saraswati in Patiala House Court. He has requested that jail officials give him a guideline which will enable him to wear Sanyasi robe and have religious books under the custody of the judges.

He is on judicial custody running in a case of molestation that was registered in Vasant Kunj North Police Station.

The arguments of Additional Public Prosecutor (APP) were heard by Judicial Magistrate First Class (JMFC) Animesh Kumar.

The APP reported that Chaitnyanand Saraswati was not a sanyasi, and there could be some law and order issue in the jail.

Advocate Manish Gandhi, counsel to Chaitnyanand Sarswati opposed these submissions. They said that he does not understand how wearing his fashionable clothes can bring law and order problems in jail.

He gave submission that Saraswati is a sanyasi and Diksha was bestowed upon her. His previous name was Parthasarathi. His name was changed to Chaitanya Saraswati, after Diksha. The Mathh (Peethham) has not refuted this position.

Advocate Gandhi wanted time to hand in papers connected with the Diksha presented to Saraswati.

The court allowed time and adjourned the hearing on the same tomorrow at 2.30 PM.

On October 8, Patala house court requested Delhi police to submit a detailed response regarding the request of Chaitnyanand Saraswati to grant Sanyasi Robe and Spiritual books with reference to the rule of Jail Manual.

In another application consisting of supplying a copy of the seizure memo to Chaitanyanand Saraswati, the order is not to be given till Tuesday.

Judicial Magistrate First Class Animesh Kumar indicated that the response submitted by the Investigation Officer is not correct, since it fails to refer to the provision in the jail manual about clothes and spiritual books.

The court had said,” prima facie, it appears there is no prohibition on clothes and books, so how can I prohibit them?”

Advocate Manish Gandhi who defended the accused also referred to the jail manual and provided that no one is prohibited to wear clothes of their own choice in case of a trial prisoner.

The defense attorney of the accused also made an oral request to the court that he be directed to bring additional bedding during the hearing because the accused is more than 65 years old and has ailments.

This court has noted that the response had included some undesirable remarks, including the allegation that the accused must not be granted the right to put on religious clothes.

The court had said, “The police should not make any such comments. We have no right to make such comments. The reply should be in accordance with the jail manual.”

The court further indicated that the interim order of the food and medicines of Sanyasi should be upheld until the subsequent date.

On October 4, Delhi police requested time to put up submissions in two applications that Chaitanyanand Saraswati had filed.

He has gone in pursuit of a path that will help him get Sanyasi food, Sanyasi Garb, spectacles, medicines and books.

He had also requested a guidance on the provision of seizure memo of the Delhi police.

The defense team of the accused had made the argument that, in accordance to the stipulations of BNSS there is no prohibition to providing the accused with the copy of the seizure memo. He was also concerned that the papers that were captured during the investigation may also be utilized in another case.

The other public prosecutor (APP) had disagreed with the submissions saying that there are guidelines which imply that the copy of the seizure cannot be given before the filing of the charge sheet.

The Patiala House Court re-sent Chaitanyanand to 14 days' judicial custody on October 3 up to October 17.
