IndiGo Sues Mahindra Over ‘6E’ Branding on Electric Vehicles

IndiGo Sues Mahindra: Mahindra in talk with IndiGo regarding the much-debated greening call sign" for the automaker's new electric vehicle models. No action was taken in this case since Judge Amit Bansal recused himself from hearing the matter. The next date is December 9. IndiGo's lawyer, Sandeep Sethi, informed the court that Mahindra had approached the airline for discussing the said issue, as reported by Bar and Bench.
IndiGo, the largest national airline of the country, has filed a suit in the High Court of Delhi for infringement of trademark against Mahindra regarding its recently launched electric BE 6e and XEV 9e, for which the company has made an application for registration of trademark.

Mahindra replied that there is none with reference to IndiGo alone's "6E" call sign. In a filing at a stock exchange, Mahindra confirmed that talks were ongoing towards an amicable solution.
IndiGo has long used "6E" as its distinctive call sign, a unique identifier in the airline industry, and has incorporated it into its branding.
In addition to 6E Prime for seat selection, priority check-in, and snacks, the airline offers 6E Flex for easy rescheduling and cancellations. Additional offerings include extra baggage and lounge access.
IndiGo also registered the trademark "6E Link" in 2015, reinforcing its commitment to brand distinctiveness and innovation.

Mahindra said that its "BE 6e" is essentially different from IndiGo's "6E." While the latter stands for an airline, the former refers to Mahindra's electric vehicles, so that there is confusion in the mind of the consumer concerning it. This will further make the two trademark distinct and unique in terms of design and usage.
The company has qualified its statements by adding, "We have considered IndiGo's concerns regarding the possible damage to the goodwill-not intended-in such situations and discussions are on with IndiGo to resolve."
