What Is Deportation? Why the US Sends Foreign Nationals Back to Their Home Countries

Deportation applies to the situation where a violation of immigration law leads to the removal of a non-citizen from the US.

On December 23 an airlifted detention, the United States deported 104 Indian nationals living there illegally. The Indians were already on a military aircraft headed for Sri Guru Ram Dass Jee International Airport in Amritsar on Wednesday. Thus the first batch of Indian deportees was due to the Donald Trump administration's stringent immigration policies.

Sources add that among the deportees, 33 were from Haryana, 33 from Gujarat, 30 from Punjab, three from Maharashtra, three from Uttar Pradesh, and two from Chandigarh. This group included 19 women and 13 minors, including a 4-year-old boy and two girls aged 5 and 7.

The deportation comes close on the heels of diplomatic talks concerning illegal immigration, a large issue ever since Mr. Trump took office about one month ago. It coincides with the sweeping movement in US anti-illegal immigration measures, showcasing a renewed emphasis targeting curtailing illegal immigration from various countries, including India.

While Indian nationals had been deported in earlier periods, this is the first time a military aircraft has been put to the operation.

What is deportation and who are deported from US?

Deportation means the funny job of expelling an alien from the United States for violation of his immigration law. The Department of Homeland Security, with its Enforcement and Removal Operations designated arm, regulates the deportations, which take place for several reasons: visa status violation, criminal activity, or poses a danger to public safety.

Deportations have long time been a sore point between the United States and India. Non-citizens who violate US immigration law or simply overstay their visas are prone to removal from the United States.

One such instance is when an arrest warrant is issued and an individual is taken into custody and security is set up in a detention area. They are kept there until they are summoned to the immigration court, belonging to the Department of Justice, which then rules if the immigrant is seeking asylum and issues an order for removal depending on the factors involved.

In some instances, the alien chooses to depart voluntarily; however, expedited removals are ordered in cases where there is a violation of entry requirements or the use of fabricated documentation.

Deportation process

Generally, when immigrants are detained for the violation of US immigration laws, they are taken to a detention center. These immigrants may be detained until a hearing is held on their case, with a judge determining whether they are qualified to stay in the United States or should be removed. In some other cases, expedited removals are conducted without a hearing, especially when immigrants get to the country without documents or violate various other entry requirements.

After the removal order is given, the majority of all deportations are by air; a few use ground transportation in conjunction with air. The US government pays for the deportation of these individuals, returning most of them to their homeland.

Impact on US-India ties

Deportation of these 104 individuals marks the first high-profile instance since the Trump administration's crackdown on illegal immigration. Although regarded as a significant milestone in the American immigration policy, it is set against the growing backdrop of diplomatic engagement between the two countries on migration issues.

Being the largest trade partner for the United States, both countries are willing to enhance their strategic partnership further against the growth of China's influence in Asia. India, too, is looking for ways to secure for its skilled workers easier US visa options-therein lies another avenue for strengthening the two countries.

When Prime Minister Modi meets President Trump next week, it is expected that both sides would have to factor in migration concerns. Discussions were to include some changes in the immigration process concerning Indian professionals looking to work in the United States.
