The Delhi High Court has quashed an attachment order of Rs 15,000 crore against the Government of India given by the International Chamber of Commerce (ICC) arbitration panel in the Dewas-Antrix case.
The Delhi High Court has set aside the order of the ICC in the Dewas-Antrix case. The International Chamber of Commerce had directed Antrix, the commercial arm of ISRO, to pay damages amounting to over USD 560 million, including interest, to Dewas Multimedia Pvt Ltd. In this case, now the Delhi High Court has set aside this order.
The Delhi High Court has quashed an attachment order of Rs 15,000 crore against the Government of India given by the International Chamber of Commerce (ICC) arbitration panel in the Dewas-Antrix case. According to senior advocate Maninder Singh, the order was passed by Justice Sanjay Sachdeva of the Delhi High Court. The shareholders of Dewas Mauritius sent a notice of arbitration to the Indian government on February 2 to directly secure their share in the $1.3 billion in damages payable by India to Dewas from the International Chamber of Commerce in the matter.
The Delhi High Court allowed the petition of Antrix Corporation and quashed the arbitral damages dated 14.9.2015 passed by the Arbitral Tribunal on the claim of Dewas Multimedia. Maninder Singh has fought this entire battle for the Government of India in this matter. The Court held that the impugned award dated 14.9.2015 is prone to patent illegalities and fraud and is against the public policy of India.
