The Supreme Court has pulled up the Enforcement Directorate (ED) for filing a petition seeking cancellation of bail of an accused suffering from cancer. The top court said the investigating agency should not have wasted stationery, legal fees and the time of the court.
The accused is a private bank employee and was arrested in the case of misappropriation of Rs 24 crore. A bench of Justices MR Shah and MM Sundresh also imposed a fine of Rs 1 lakh, which will have to be paid by the officer who granted the permission to file the special leave petition.
The bench said that the said amount would be deducted from the salary of the officer concerned and the department would deposit the same in the registry of this court within four weeks. Out of the fine amount, Rs 50,000 will be transferred to the National Legal Services Authority, New Delhi and Rs 50,000 to the Arbitration and Conciliation Project Committee of the Supreme Court.
The ED had challenged the November 12, 2021 order of the Allahabad High Court, in which it had granted bail to the accused as he was suffering from cancer. The High Court had also requested the concerned doctor of Kamla Nehru Hospital in Prayagraj to examine the accused and file a report on his health condition and stage of cancer.
