In a plea before the sessions court on Friday, the accused, Mohammad Shariful Islam Shehzad, claimed that "the first information report is patently false and a false case has been registered against him".
His lawyer also argued that Shehzad has been cooperating with the authorities and claimed that there is no risk of him tampering with any evidence even if he gets bail.

The bail plea also argued that Islam’s continued detention serves no purpose beyond pre-trial punishment. “The applicant has cooperated with the investigation. Therefore, no useful purpose will be served by detaining him further in custody, save and except pre-trial punishment," it added.
Currently, the case is being handled by the Bandra Magistrate Court, but it falls under the jurisdiction of the Mumbai Sessions Court. Once the police file a charge sheet, the case will be transferred to the Sessions Court. However, the charge sheet is yet to be filed.
According to media reports, doctors removed a 2.5-inch knife from Saif's wound. The actor sustained six stab injuries, two of which were serious as they were near his spine.
The attack took place in the early hours of 16 January when the accused allegedly entered Saif's Bandra residence through his youngest son Jeh's room.

The incident reportedly occurred around 2:15 am on January 16 when the accused broke into the house, attacked the house help, and then stabbed Saif when he intervened.
Saif Ali Khan was stabbed six times by the robber, following which he was rushed to the hospital. The actor was discharged on January 21.
Mohammad Shariful Islam Shehzad was arrested by the police two days after the attack. Before the arrest, Mumbai Police had detained two other individuals as suspected attackers on the basis of the CCTV footage from the actor's building.
In his bail application, the accused argued that his arrest was illegal, accusing the investigation agency of "blatantly disregarding" Section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which relates to informing an individual about the grounds of their arrest and their right to bail.
The plea also challenged the validity of the charge, stating that even if witness statements were taken at face value, they would not meet the requirements of the Bharatiya Nyaya Sanhita (BNS) Section 311, which covers serious crimes like robbery or dacoity with intent to cause death or grievous harm.
