Rape case should be registered against BJP leader Shahnawaz Hussain: Delhi High Court
Advocate Manish Paul, appearing for Shahnawaz, had urged CJI NV Ramana to hear the matter immediately. If FIR is registered then this petition will become ineffective. He has a public life of 30 years, but the CJI said that he will hear next week.
The Delhi High Court has ordered the police to register an FIR against Shahnawaz Hussain under sections including rape. Delhi HC has directed the police to complete the investigation in three months. The Delhi High Court said that it is clear from looking at all the facts that there is complete reluctance on the part of the police till the registration of FIR in this case. The court said that the report presented by the police in the lower court was not the final report.
The trial court had rejected the police's argument that the woman's complaint contained a cognizable offence. The police had submitted in the report and said that the case against Hussain was not made out, but in January 2018, a Delhi-based woman had filed a petition in the lower court requesting to register an FIR against Hussain for rape. The woman had alleged that Hussain raped her at Chhatarpur farm house and threatened to kill her.
BJP leader Shahnawaz Hussain has reached the Supreme Court against the order of the Delhi High Court. The order to register an FIR of rape has been challenged. The Supreme Court has refused an early hearing for the time being. The Supreme Court said that it will hear next week.
