Important decision may come in Supreme Court today on the validity of EWS reservation

The Supreme Court will deliver its verdict today on petitions challenging the validity of the 103rd Constitutional Amendment providing 10 per cent reservation to the economically weaker sections (EWS) in admissions and government jobs. According to the cause list uploaded on the apex court's website on November 7, a five-judge constitution bench headed by Chief Justice Uday Umesh Lalit will pronounce the verdict in the matter.

The apex court, after hearing the arguments of senior lawyers including the then Attorney General KK Venugopal and Solicitor General Tushar Mehta, had on September 27 reserved its verdict on the legal question whether the EWS reservation violated the basic structure of the Constitution. Educationist Mohan Gopal had argued the matter before the bench on September 13 and opposed the EWS quota amendment, calling it an attempt to destroy the concept of reservation "through the back door".

The top court heard 40 petitions. The validity of the Constitution Amendment (103rd) Act, 2019, has been challenged in almost all the petitions, including the main one filed by Janhit Abhiyan in 2019. The central government had filed a few petitions requesting various high courts to transfer pending cases challenging the EWS quota law to the apex court for a decision. The Center has made a provision for reservation for economically weaker sections in admission and government services through the 103rd Constitutional Amendment Act, 2019.
