The Delhi High Court has stayed the re-polling for the election of the members of the Standing Committee of the MCD. The poll was scheduled to be held on February 27, 2023. Now the process of voting will not take place after the ban by the court. Along with this, the High Court has also issued notices to LG, Mayor, Deputy Mayor and MCD. Along with this, the court has directed that the mayor should preserve all other information along with the recording of the ballot paper, CCTV footage, to facilitate further hearing.
Hearing a petition filed by the BJP, the Delhi High Court said that it is nowhere written in the Constitution that the Mayor has the right to declare the election of the members of the Standing Committee invalid. The court said that conducting re-election without declaring the results of the previous elections prima facie shows non-compliance of rules.
After the election held on Friday (February 24), before the results were announced, Mayor Shaili Oberoi declared the vote of a BJP councilor invalid, which was opposed by the BJP. The mayor again called for the election of committee members on February 27 Had ordered elections, against which BJP had filed a petition in the High Court. The court has given this decision while hearing this petition.
