The Supreme Court College, headed by Chief Justice of India NV Ramana, has approved the proposal to elevate senior lawyer Saurabh Kirpal as a judge of the Delhi High Court. "The College of the Supreme Court, at its meeting on November 11, 2021, approved the proposed elevation of Saurabh Kirpal, a lawyer, to judge in the High Court of Delhi," said a statement from the college. The three-member panel that makes recommendations to the High Court judges includes Judge UU Lalit and Judge AM Khanwilkar.
According to media reports, in October 2017, the Delhi High Court Collegium, then headed by Acting Chief Justice Gita Mittal, unanimously recommended Saurabh Kirpal, for appointment as a permanent judge of the Delhi High Court. The proposal was then also approved by the college of the highest jurisdiction. The Center, however, objected to his recommendation on the grounds of his alleged sexual orientation. The controversy over his recommendation and the objection reported by the Center has been widely speculated in the courtrooms for the past four years.
Kirpal has brazenly spoken regarding his sexual orientation. an ani report quoted Kirpal as expression in an interview this year, "The indisputable fact that my partner of twenty years may be a person of foreign origin is a security risk is such a specious reason that it leaves one to believe that it's not the complete truth. that's the rationale i think my sexuality is that the reason why my cause has not been thought-about for elevation as a judge."
In other statement, the Collegium of the Supreme Court, at its meeting on November 11, 2021, also decided to reiterate its previous recommendation for the elevation of four lawyers to the post of judges of the High Court of Delhi. The four lawyers are Tara Vitasta Ganju, Anish Dayal, Amit Sharma and Mini Pushkarna.
