A petition has been filed in the Supreme Court on behalf of Benazir Hina of Ghaziabad, in which it has been demanded that Talaq-e-Hasan and Talaq-e-Ehsan should also be declared crimes like Talaq-e-Biddat (triple talaq). to be done.
After the decision on triple talaq, now the issue of talaq-e-hasan has come to the fore. A petition has been filed in the Supreme Court on behalf of Benazir Hina of Ghaziabad, in which it has been demanded that Talaq-e-Hasan and Talaq-e-Ehsan should also be declared crimes like Talaq-e-Biddat (triple talaq). to be done.
The Supreme Court on 22 August 2017 declared that it is unconstitutional to break the marriage by saying only triple talaq. This process, called talaq-e-biddat, was also said by most of the Muslim Ulemas that it is not according to the Quran.
The victim has filed the petition through advocate Ashwini Kumar Dubey. Benazir was married on 25 December 2020 to Yusuf Naqi of Delhi under Muslim customs and also has a boy. In December last year, Yusuf threw her out of the house after a domestic dispute. For the last 5 months, without any contact, Yusuf, through his lawyer, sent a letter by post. In which it is written that he is giving the first divorce under Talaq-e-Hasan.
Benazir also said that her parents were forced to pay dowry and later harassed for not paying a huge amount. She also claimed that her husband and family members physically and mentally tortured her not only after marriage but also during pregnancy, which made her seriously ill. Benazir said that Talaq-e-Hasan is not a fundamental principle of Islam.
